Welcome to nit-picky.com (the “Site”), operated by Nit Picky® and Nit Picky Inc. (“Company,” “we,” “us,” or “our”). By accessing the Site, scheduling services, purchasing products, or communicating with us, you agree to be bound by these Terms and Conditions.
If you do not agree, do not use the Site or services.
1. SERVICES
Nit Picky® provides professional head lice screening and removal services and related products.
Results vary based on:
severity of infestation
compliance with aftercare
environmental exposure
re-exposure from third parties
We do not guarantee prevention of reinfestation.
All services and content are for personal, non-commercial use.
We reserve the right to refuse or discontinue service at our discretion.
2. APPOINTMENTS, DEPOSITS, AND CANCELLATIONS
Scheduling
Appointments may be scheduled online, by phone, or by SMS.
A reservation deposit is required to secure all appointments and is applied toward the service total.
Technician time is reserved specifically for each client and may require declining other appointments.
Cancellation Policy
We maintain a strict 24-hour cancellation policy.
Appointments cancelled or rescheduled within 24 hours of the scheduled time will forfeit the reservation deposit.
Same-day cancellations or appointment changes are not accepted.
Rescheduling is not guaranteed and is offered solely at the discretion of our office.
Late arrivals, missed appointments, inability to access the service location, or failure to provide accurate information are treated as cancellations within the 24-hour window.
Dispatch and Earned Fees
Once a technician has been scheduled, dispatched, is en route, or has arrived at the appointment location, service fees are considered earned due to reserved time and travel incurred.
Services rendered are non-refundable once completed.
Service Area
In-home services are available only within designated service areas.
Travel fees, tolls, parking, and extended travel time may apply.
Emergency, after-hours, or holiday appointments may be subject to additional fees.
3. PRODUCTS AND ORDERS
Availability
Products may be modified or discontinued without notice.
Pricing
Prices are subject to change without notice. We reserve the right to correct pricing errors or cancel orders.
Order Acceptance
We may refuse or cancel orders for any reason including suspected resale, misuse, or fraud.
Product Use
Products are for personal use only and not for resale unless authorized.
Shipping and Returns
Products purchased during in-home services are final sale.
Products shipped directly from the Company may be returned within 14 days if unopened and in original packaging with proof of purchase.
Shipping fees are non-refundable. Return shipping is the customer’s responsibility.
We reserve the right to deny returns that do not meet requirements.
4. SMS, CALL, AND EMAIL COMMUNICATIONS
By providing your contact information, you consent to receive calls, emails, and text messages from Nit Picky® regarding:
scheduling
reminders
receipts
service updates
aftercare
Message frequency varies.
Message and data rates may apply.
Reply STOP to unsubscribe.
Consent to receive communications is not a condition of purchase.
We do not sell or share mobile opt-in data for marketing purposes.
5. CLEARANCE CERTIFICATES
Certificates confirm services were rendered at the time of appointment.
They do not guarantee school re-admittance or future lice-free status.
6. INDEPENDENT TECHNICIANS AND SERVICE PROVIDERS
Nit Picky® may schedule certified technicians or contractors to perform services.
Technicians may operate as independent contractors or licensees.
To the fullest extent permitted by law, the Company is not liable for acts or omissions of independent contractors beyond the scope required by applicable law.
All technicians follow Company protocols and standards.
7. WEBSITE USE
You agree not to:
violate laws
misuse the Site
interfere with operations
attempt unauthorized access
post harmful or misleading content
We may restrict or terminate access at any time.
8. DISCLAIMER OF WARRANTIES
Services, products, and the Site are provided “as is” and “as available” without warranties of any kind.
We do not guarantee:
complete eradication after one treatment
prevention of reinfestation
uninterrupted website access
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our services, products, or website.
This includes, but is not limited to:
reinfestation
third-party exposure
missed work or school
emotional distress
travel time
scheduling delays
Maximum Liability Cap:
In all circumstances, the total liability of the Company shall not exceed two (2) times the total amount paid for the service or product giving rise to the claim.
This limitation applies regardless of the legal theory asserted.
10. INDEMNIFICATION
You agree to indemnify and hold harmless the Company, its owners, employees, contractors, and affiliates from any claims, damages, losses, or expenses arising from:
failure to follow aftercare
misuse of products
third-party exposure
inaccurate information provided
violation of these Terms
11. FORCE MAJEURE
We are not liable for delays or failure to perform due to events beyond our control, including:
illness
weather
traffic
natural disasters
government actions
power or technical failures
12. DISPUTE RESOLUTION AND BINDING ARBITRATION
Any dispute arising from services, products, or use of the Site shall be resolved exclusively through binding arbitration in the State of California.
You agree:
to waive the right to a jury trial
to waive participation in class actions
to bring claims only in your individual capacity
Arbitration shall be conducted under applicable California rules.
13. GOVERNING LAW
These Terms are governed by the laws of the State of California.
Venue for disputes shall be within California.
14. CHANGES TO TERMS
We may update these Terms at any time.
Continued use of the Site or services constitutes acceptance of revised terms.
